1. About these terms
These terms govern participation in the Walls That Pay program ("the Program"), operated by Bonheur Creatives Pty Ltd trading as Olive et Oriel ("Olive et Oriel", "we", "us", "our").By registering for the Program you ("you", "the Participant") agree to these terms in full. If you do not agree, do not register and do not use any link, code or asset issued to you.
The Program is a customer referral program. It is not a general affiliate network, a media buying arrangement, or an advertising partnership. It exists so that people who have bought from us and love their walls can share their Olive et Oriel purchase with others and be rewarded when someone buys via their unique link.
2. Eligibility To be eligible you must: a) be an individual aged 18 years or over; b) have placed and paid for at least one genuine order with Olive et Oriel from oliveetoriel.com under your own name and delivery address, which has not been fully refunded or charged back; c) register using your own real name and the email address associated with that order; d) hold and operate the social media account or website through which you promote, in your own name or the name of your own genuine business; e) not be an employee, contractor or immediate family member of an employee of Olive et Oriel unless approved in writing; f) hold one Program account only. Registration is instant and does not require our approval. Instant registration is not acceptance, endorsement or verification of eligibility. We verify eligibility on an ongoing basis and may suspend, decline or close any account that does not meet the requirements above.
3. Prohibited participants and prohibited channels. The Program is expressly limited to genuine customers promoting through their own personal or business social media, website, newsletter or in-person word of mouth. The following entities and channels are not permitted to participate in the Program under any circumstances, whether they have placed a qualifying order or not: 3.1 Coupon, voucher, promotional code and deal websites, including sites whose primary purpose or a material part of whose content is the aggregation, listing, publication, submission, crowdsourcing or distribution of discount codes, coupons, promotional codes, vouchers, sale alerts or deal notifications. 3.2 Cashback, rewards, points and loyalty aggregators, including any site, app or platform offering users a rebate, cashback, points, credit or other incentive for transacting through a tracked link. 3.3 Browser extensions, toolbars, plug-ins, code injectors and auto-apply tools, including any software that inserts, tests, applies or overwrites tracking parameters, cookies or promotional codes at or near the point of checkout. 3.4 Deal forums, bargain communities and code-sharing groups, including bargain forums, deal subreddits, code-sharing Facebook groups, Telegram or WhatsApp deal channels and equivalent. 3.5 Code scraping, code guessing and code brokerage operations, including any party that generates, tests, harvests, resells, trades or brokers promotional codes. 3.6 Unauthorised resellers and marketplace sellers, including any party listing Olive et Oriel products or offering to place Olive et Oriel orders on behalf of third parties through eBay, Amazon, Etsy, Facebook Marketplace, Gumtree, Catch, or any similar platform. 3.7 Any party misrepresenting itself as Olive et Oriel or as an official, authorised, licensed or exclusive channel, distributor or outlet of Olive et Oriel. 3.8 Any party operating on behalf of, funded by, owned by or affiliated with any of the above, including through a nominee, family member, staff member, secondary account or shell entity. Registration by any party described in this clause is void from the outset. No commission is earned, accrued or payable on any activity generated by such a party, whether or not the account was active for a period before detection.---
4. Prohibited conduct Regardless of who you are, you must not: 4.1 Publish, submit or distribute your link or any Olive et Oriel promotional code to any site, app, forum, group or platform described in clause 3.
4.2 Publish your link or code in any context where it is presented as a discount, coupon, voucher or promotional code rather than as your personal referral link.
4.3 Bid on our brand terms in paid search. You must not bid on, purchase or use as a keyword, negative-match exception, ad headline, display URL or ad copy element any of the following or any misspelling, variation or combination of them: "Olive et Oriel", "Olive and Oriel", "oliveetoriel", "OEO wallpaper", "Olive et Oriel discount", "Olive et Oriel code", or any Olive et Oriel product name, artwork title or collection name. This applies to Google Ads, Microsoft Ads, Meta, TikTok, Pinterest, Amazon and all other paid platforms.
4.4 Use our trademarks in a domain, subdomain, app name, social handle, page name or profile name in a way that suggests you are Olive et Oriel or an official channel of Olive et Oriel. Descriptive personal use such as "sarah loves Olive et Oriel" is acceptable. "OliveEtOrielDiscounts" or "OEOCodes" is not.
4.5 Register or operate typosquatted, misspelled or confusingly similar domains.
4.6 Direct-link or redirect from paid advertising tooliveetoriel.com** without our prior written approval.
4.7 Send unsolicited commercial electronic messages containing your link or code. All email and SMS activity must comply with the Spam Act 2003 (Cth).
4.8 Make any false, misleading or deceptive representation about Olive et Oriel, our products, our pricing, our delivery times, our manufacturing, or the terms of any offer. This includes advertising a discount that is not available, advertising an expired code as current, or representing that a code is exclusive when it is not. You must comply with the Australian Consumer Law and, where you are promoting to audiences outside Australia, the equivalent consumer protection law in that market.
4.9 Fail to disclose your commercial relationship with us. Every post, story, video or email promoting Olive et Oriel must clearly disclose that you earn commission, using a plain and prominent label such as #ad, "paid partnership", "commission earned" or "affiliate link", consistent with the ACCC and AANA Code of Ethics requirements for influencer marketing.
4.10 Generate self-referred, circular or manufactured transactions.
You may not earn commission on your own orders, orders to your own address, orders paid for by you, orders placed by you on behalf of a customer, or orders arranged for the purpose of triggering commission or reaching a higher tier.
4.11 Cookie stuff, force-click, iframe, pop-up, pop-under, auto-redirect or otherwise set tracking without a genuine user click
on your content.
4.12 Post content that is unlawful, defamatory, obscene, discriminatory, or that infringes any third party's intellectual property or privacy. You must not use another person's photography, styling images or video as your own.
4.13 Sub-affiliate, syndicate, resell, licence or otherwise pass on your link, code or Program access to any third party.
4.14 Attempt to circumvent these terms, including through multiple accounts, altered link parameters, cloaked redirects, or intermediaries.
5. Commission, tiers and payment
5.1 Commission rates.
Commission is calculated on the net order value, being the product price paid by the customer excluding shipping, taxes, duties, gift cards and any amount refunded.

Tiers are based on total confirmed referral sales within a calendar month and reset on the 1st of each month. Tier movement applies to sales in the month in which the threshold is reached.
5.3 Attribution.
Commission is attributed on a last-click basis through our tracking platform, subject to a tracking cookie window. Attribution is determined solely by our records. Where a customer's final click before purchase comes from a channel or party prohibited under clause 3, no commission is payable to any party for that order.
5.4 Confirmation period.
Commission is held for 30 days from the order date and is confirmed only after that period has passed without return, cancellation, chargeback or fraud indicator.
5.5 Payment.
Confirmed commission is paid monthly to the payment details you provide. You are responsible for the accuracy of those details. We are not liable for payments sent to details you have entered incorrectly.
5.6 Tax.
You are responsible for your own tax obligations. Commission is paid to you as an independent individual or business. Nothing in the Program creates an employment, agency, partnership or joint venture relationship between you and Olive et Oriel. If you are registered for GST you must notify us and provide your ABN.
5.7 Adjustment and reversal.
We may reverse, withhold or adjust commission where an order is refunded, cancelled, charged back, fraudulent, duplicated, placed in breach of these terms, or attributed in error.
6. Consequences of breach
If we reasonably believe you have breached these terms, or that your participation is inconsistent with clause 3, we may take any or all of the following actions without prior notice:a) suspend or permanently close your Program account;
b) deactivate your link and any codes issued to you;
c) forfeit all unpaid, pending and unconfirmed commission in your account, including commission on orders unrelated to the breach;
d) recover commission already paid to you, as a debt due and payable to us;
e) cancel any pending Olive et Oriel orders connected to the breach;
f) block your access tooliveetoriel.comand refuse to accept future orders from you;
g) issue a takedown, cease and desist or trademark complaint to the relevant platform, host, registrar or search engine;
h) report the conduct to the platform, network, payment provider or regulator;
i) pursue any other remedy available to us at law or in equity, including injunctive relief and recovery of costs.
Forfeiture of commission under this clause is a genuine pre-estimate of the loss and administrative cost caused by unauthorised activity, and reflects that no commission is earned on activity that falls outside the Program.
7. Content, brand and intellectual property
7.1 All Olive et Oriel names, logos, artwork, artwork titles, product photography, wallpaper designs, styled imagery and copy are owned by or licensed to Bonheur Creatives Pty Ltd or the contributing artist, and are protected by copyright and trade mark law.
7.2 We grant you a limited, revocable, non-exclusive, non-transferable licence to use our name and approved brand assets solely for the purpose of promoting Olive et Oriel under these terms. This licence ends immediately on suspension, closure or termination of your Program account.
7.3 You must not alter, recolour, crop over, or overlay our logo, and you must not create derivative works from our artwork or wallpaper designs.
7.4 By tagging @oliveetoriel or using your Program link in a post, you grant us a perpetual, worldwide, royalty free, non-exclusive licence to repost, reproduce and adapt that content across our marketing channels, with credit where practicable.
8. Privacy
Personal information collected through the Program is handled in accordance with the Australian Privacy Principles and our Privacy Policy at oliveetoriel.com/pages/privacy-policy. We may use tracking, device, IP address, payment and order data to detect and investigate breaches of these terms.
9. Changes, suspension and termination
9.1 We may amend these terms at any time. The current version is published at this page and applies from the date of publication. Continued participation after a change constitutes acceptance.
9.2 We may change commission rates, tier thresholds, cookie windows, confirmation periods and payment schedules on reasonable notice. Changes apply prospectively.
9.3 We may suspend, modify or discontinue the Program in whole or in part at any time.
9.4 You may leave the Program at any time by contacting us. Confirmed commission accrued before departure remains payable, subject to clause 6.
10. Liability
To the maximum extent permitted by law, and other than for liability that cannot be excluded under the Australian Consumer Law: a) the Program is provided on an as is basis; b) we are not liable for tracking failure, platform outage, cookie loss, ad blocker interference, browser restrictions or any other technical event that prevents attribution; c) we are not liable for any indirect, consequential, special or economic loss, including loss of expected commission, revenue, opportunity or goodwill; d) our total aggregate liability to you in connection with the Program is limited to the total confirmed commission paid to you in the 12 months preceding the claim. You indemnify us against any claim, loss, cost or liability arising from your breach of these terms, your content, or your conduct in promoting Olive et Oriel.
11. General
11.1 Governing law.
These terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.*
11.2 Severance.
If any provision is found unenforceable, it is severed and the remainder continues in force.
11.3 No waiver. Our failure to enforce a provision is not a waiver of that provision.
11.4 Entire agreement. These terms, together with our Terms of Service and Promotional Offer Terms, form the entire agreement in relation to the Program.

Unauthorised Use of Promotions and Promotional Codes Olive et Oriel, a registered trading name of Bonheur Creatives Pty Ltd (ABN 63 618 780 573)
These terms apply to every discount code, promotional code, voucher, offer, cashback, gift with purchase, referral link and campaign issued by Olive et Oriel, however it is received. They apply to all customers, subscribers, referral Participants, trade account holders and any other person who comes into possession of an Olive et Oriel code or link.
1. Codes are personal and conditional
1.1 Every promotional code and referral link issued by Olive et Oriel is a personal, limited, revocable licence granted to the intended recipient only.
1.2 Codes are non-transferable and have no cash value. They may not be sold, traded, brokered, auctioned, gifted for consideration, or bundled with any other product or service.
1.3 Unless expressly stated otherwise in the campaign, codes are limited to one use per customer, per household and per payment method.
1.4 Codes may not be combined with any other offer, and may not be applied retrospectively to an order already placed. 1.5 Codes may be withdrawn, deactivated or reissued at any time without notice, including before a stated expiry date.
2. Unauthorised distribution You must not, and must not permit any other person to:
2.1 publish, submit, upload, syndicate, crowdsource or otherwise make available any Olive et Oriel promotional code or referral link to a coupon site, voucher site, deal site, cashback site, rewards platform, browser extension, bargain forum, deal group, code-sharing channel or any similar service; 2.2 collect, scrape, generate, guess, brute force or systematically test codes against our checkout; 2.3 represent an expired, restricted, single-use, private or staff code as a current or publicly available offer; 2.4 represent yourself as an authorised source of Olive et Oriel discounts, or use our name, logo or trade marks in a manner suggesting official endorsement of a discount listing; 2.5 operate a browser extension, script or automation that inserts, applies, tests or overwrites codes or tracking parameters at checkout; 2.6 use a code issued to another person, or use a code obtained from a source described in clause 2.1.
3. Codes issued for a specific purpose
Codes issued for a specific purpose remain restricted to that purpose. This includes, without limitation:a) service recovery and goodwill codes issued to an individual customer; b) trade, commercial and designer account pricing; c) artist, licensor and supplier codes; d) staff and family codes;e) event, showroom, publication and partnership codes; f) sample, cashback and campaign codes tied to a specific product or period. Use of such a code by any person other than the intended recipient, or for any purpose other than the intended purpose, is unauthorised.
4. Our rights where a code is used without authorisationWhere we reasonably believe a code or link has been obtained, published or used in breach of these terms, we may: a) deactivate the code immediately, including for all other holders of that code; b) refuse, cancel or hold any order placed using the code, before or after dispatch; c) reverse the discount and require payment of the balance before the order is released; d) refund and cancel the order in full at our discretion; e) withhold, forfeit and recover any referral commission connected to the code or link; f) close the associated customer account, referral account or trade account; g) block the associated email address, payment method, device and IP address from placing future orders; h) issue takedown or cease and desist notices to the publisher, platform, host or registrar; i) pursue recovery of loss, and any other remedy available at law. Cancellation of an order under this clause is not a rejection of a valid contract of sale, as no valid offer exists where the price was obtained through unauthorised use of a code.
5. Nothing in these terms limits your consumer guaranteesNothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where goods have been supplied to you, your consumer guarantees in respect of those goods are unaffected.
6. Reporting misuse
